Digital transformation and interoperable platforms for public contracts: new challenges for the qualification of suppliers

The paper analyses the digital transformation of the public procurement cycle. The UN's AI for good initiative provides a framework to address the fair use of interoperable platforms to collect data for smart procurement and effective execution for the benefit of all stakeholders.
In the European Union, the new Tender Electronic Daily platform is evolving from a mere advertising interface to a data system (Procurement Data Space) with common ontologies.
The European Single Procurement Document (ESPD 4.0) and e-invoicing resulting from the recent Recovery and Resilience Plans (post-Covid emergency) will be examined, as well as the development of advanced and integrated e-procurement platforms (with native e-forms), which may lead to a profound change in market analysis, supplier qualification and evaluation.
Indeed, the ESPD should evolve from a self-certification presented for each individual tender to a reusable Virtual Company Dossier, a digital identity wallet fully interoperable with different databases (according to the once-only principle). This evolution is in line with the development of the Digital Identity Wallet discipline, which includes the qualification of companies and the integration of the European regulation on the new digital identity (EIDAS 2).
In US federal procurement, a similar evolution is developing for supplier qualification with DORA (Determination of Responsibility Assistant), a chatbot that pulls information from public websites such as SAM (System for Award Management) and the Federal Awardee Performance and Integrity Information System (FAPIIS): the DORA chatbot checks whether the company is listed on SAM, the actual US blacklist of debarred companies.
The Building Information Modelling approach and the Digital Twin method, from the design to the management of the work, could bring new efficiencies and a paradigm shift towards "digital trust" between public entities and suppliers, to be developed in framework alliances for the benefit of all stakeholders. Prompt and fair execution will become the common goal, overcoming opportunistic behavior thanks to the evidence of data.
